Appeal submitted that the impugned judgement suffers from grave infirmities, which is apparent from the fact that, while dealing with the present complaint, the Trial Court completely departed from the facts in issue and made general observations, without addressing the averments made by the complainant, moreover, while doing so, the Trial Court has not ascribed any reason for disregarding the evidence led by the Complainant, as well as the testimony of the Complainant's witnesses.

The appeal further submitted that "the impugned judgement suffers from non-application of mind, which has led to crucial errors. Robert and Jackson streets, between Kellogg Boulevard and Fourth Street, will be closed beginning next Tuesday and for the entire trial. Parking will be restricted on the north side of Kellogg Boulevard from Cedar to Robert streets. The Capital City Bikeway on Jackson Street in the block between Kellogg and Fourth was closed when the fencing went up and will remain closed during the trial.

Starting Tuesday, the portion of Jackson Street that is closed will be available for bicyclists and pedestrians to get through.
